Court Reversal Allows
Girl to Wed Non-,Jew
NEW YORK, (JTA)-The New
York State Appellate Court
ruled that a Jewish girl May
marry a non-Jew and continue
to receive an interest in her
great-grandfather's estate, de-
spite a provision in his will that
none of his descendants who
"marries a person not of the
Jewish faith and not of Jewish
blood" may receive a legacy
left by him.
Reversing a Surrogate Court's
decision, the Appellate Court
said that Miss Jean Tanburn,
the great-granddaughter of the
late Abraham S. Rosenthal,
could continue to receive $6,500
a year income from a $675,000
trust fund, and a $10,000 cash
legacy despite the fact that she
will marry Donald Morrison
Kelley, Jr., a non-Jew.
The court's ruling was based
on the fact that Miss Tanburn
did not inherit directly from
Mr. Rosenthal but from her
father, the late Stephen A. Tan-
burn. A minority opinion on
the • three-to-two decision noted
that the interpretation of the
majority was unprecedented.

Music Month March 7
In celebration of Jewish Music
Month, the United Hebrew
Schools will present its second
annual music festival, sponsored
by the Parent-Teachers Organ-
ization Council, Sunday, 3 p.m.,
at Beth Aaron Synagogue.
Participants will be the Chil-
dren's Choir and the Parent-
Teachers Choral Ensemble per-
forming "The Seven Golden
Buttons," a cantata written by
Judith and Ira Eisenstein. Ted
Wolf will perform on the clari-
net and Israel Hochberg on the
chalil, a shepherd's flute.
The Jewish Center Dance •
Group will appear in Chassidic
and Israeli dances.
A special feature will be a.
joint Parent-Teacher Choral
Ensemble in which members of
the PTO will participate.
The festival's director is Julius
Schwartz, music director of the
schools.

Columbia Law Review Cites
Ground for New Sobell Trial
The Columbia Law Review has
found strong merit in arguments
for a new trial for Morton So-
bell, who was convicted with
Ethel and Julius Rosenberg and
condemned to 30 years in Alca-
traz. •
The review also found that
the rights of the Rosenbergs did
not get full legal consideration
in the final stage of their case.
Defends Blondy as
`Willing to Learn'
Editor, The Jewish News:
The Jewish News is again in
the forefront in calling the
attention of the Jewish com-
munity to the dangers inherent
in the State Release Time Bill
(State Senate Bill 1040). which
permits the release of children
for religious Instruction during
the school time.
Re the failure of the Blondy
Brothers to study the issue
which involves the fundamental
principle of separation of church
and state, may I point out this
in their favor: •
When Allen Blondy was phon-
ed the weekend after the Senate
passed the bill, he admitted that
he was unaware of the implica-
tions. He was eager to listen to
the reasons why" opposition to
Bill 1040 is taken by the Jewish
Community Council, the Ameri-
can Jewish Congress and prom-
lent rabbis in our community.
He not only arranged to see
representatives of the organiza-
tions mentioned, but took read-
ing material on the bad experi-
ences of other communities in
other states with religion in the
public school set-up. Senator
A. Blondy agreed to do what-
ever he can to.- get further con-
sideration for hearings on this
bill where opposition arguments
would have a chance to be pre-
sented in the legislature.
Release time in the public
schools for religious instruction
is one of the best kept secrets
of our time. The great majority
of people are unaware of what
it is and the dangerous prece-
dent it sets. I think it speaks
well when our public officials
are willing to inform themselves
and take action when matters
of this nature are brought to
their attention.
