McC- Arran Act's

New Provisions
Not Well Known

The McCarran Act, which goes
into effect Dec. 24, is a codifica-
•ton of previous legislation and
introduces new provisions gov-
erning immigrants and 'aliens.
Under the ACt, all aliens (re-
gardless how long they have
lived in the United States, if
they have not yet become citi-
' tens) are required to register
and be fingerprinted. If they
arrived in the U.S., after June
1940 they were registered at the
_ time of the visa issuance, and if
they were 14 years old or older
at the time they were also fin-
gerprinted.
Every alien must notify the
immigration authorities in writ-
ing of each change of address
and new address within 10 days
. from such change. Aliens who
. are non-immigrants are, in ad-
dition to the annual address re-
ports, required to report their
addresses every :three months,
_regardless of whether their ad-
dress is changed or not.
Failure to register, giving false
information, or failure to carry
the registration card on one's
person is punishable by fine, im-
prisonment or both. The Mc-
Carran Act lists some 17 classes
of aliens who may be deported
—chiefly those who 'entered the
U.S. through fraud, those com-
mitting a crime involving moral
turpitude, those violating the
alien registration laws, those be-
coming public charges within
five years after entry, for causes
existing prior to entry, -and
those who engage in subversive
activities.
With respect to the deport-
ability of subversives, this means
membership in, affiliation with,
or support of organizations that
:are considered subversive. There
is no clear way of defining sub-
versive, except that it refers to
communist or communist front
groups. Aliens are cautioned to
exercise their judgement regard-
ing . organizations, movements or
causes which they might con-
sider joining or supporting.
The McCarran Act makes it
possible to revoke the citizen-
ship of n a t u'r alize d citizens
under certain conditions. These
are refusal, within 10 years after
naturalization, to testify before
congressional committees inves-
tigating subversive a c t i v i ties;
membership in a subversiveor-
ganization within five years
after naturalization if such na-
turalization took place after Dec.
24, 1952; and taking up perma-.
nent residence in a foreign
country within five yearS after
baturalization.
