East Side, West Side
Is a rabbinic body liable for damages resulting from the pro-
nouncement of a religious precept? We will know the answer to
this question some months later when a decision on the issue is
reached before the New York Supreme Court. This will not be
the first time that a Jewish controversy has been dragged into
court. But never in the memory of the American Jewish corn-
munity has a rabbinic body been questioned in court on the
right of exercising its religious functons.
The story goes back to last Hanukah. A week or so before
the holiday the Yiddish press in New York City carried ads of a
concert that was to take place in one of the leading orthodox
synagogues in the heart of the East Side. People rubbed their
eyes when they read that the concert was to feature a choir corn.,
posed of females.
FaPing Ramparts?
They could not believe, the East Siders, that. such an innova-
tion as a female choir was possible in the bulwark of orthtdoxy.
Had there been a mistake? Had Reform Jews suddenly taken
possession of the famous orthodox stronghold on Norfolk Street?
The Vaad Harabonim of Greater New York summoned the
president of the shul and advised him it was against Jewish law
to permit a choir of women to sing M. a synagogue. The president
was amenable. He agreed to make a public announcement in the
press that the female choir would be barred from the synagogue.
The announcement said the step had been taken following a
strong protest by the rabbinic organization. But when time for
the concert got around the president was ill and the concert with
the feminine singers was held as scheduled. 'Before the concert
the rabbinical organizations, in its weekly Friday broadcast over
one of the radio stations,. called the situation to the attention of
the Jewish public, reminded the listeners it was a sin to hold such
a concert. in a synagogue and advised them to boycott the func-
tions and return purchased tickets.
Cantors' Cant
Things passed quietly until recently, when one of the cantors
participating in the concert began a $20,000 damage action against
the Vaad Horabonim. His complaint is that rabbinic interference
hampered the sale of tickets. Interestingly enough the cantor
whose four-daughter-choir precipitated the controversy was not
a party to the litigation. Now the East Side is going in circles.
Confidence in cantors is at its lowest and shul presidents are said
to be wary about renting out their synagogues to private cantors
for business entertainments. With the lawer for the rabbis him-
self a rabbi, the law suit promises to add a bit more of color to
that

As Slaying Redress
