Jewish Court's Position
In Community Explained
Editor, The Jewish News,
One of the first Jewish insti-
tutions set up in Jewish com-
munities in Europe was a Jewish
court. This took place centuries
before the courts of the land de-
veloped a system of law and
legal procedure that could be
compared to Talmudic Law.-Dis-
putes among Jews were .almost
universally- referred to the Beth-
din and resolved by the applica-
tion of Jewish legal principles.
In Jerusalem and later in Ba-
bylonia, with the consent of the
setulat government, Jew i s h
courts rendered decisions in
criminal as well as civil cases.
Jews, because of their preference
for their own law and their dis-
inclination to bring their quar-
rels before the non-Jewish popu-
lation, relied upon Jewish courts
to adjudicate all controversaries,
among them.
The motivations of this tradi-
tion are several. There is the
element of "Chillul Ha-Shem"—
the humiliation involved in. air-
ing a dispute with specifically
Jewish aspects and requiring an
understanding of Jewish back-
grounds in an arena where it is
likely to be misunderstood. Dis-
agreements among Jews were
generally regarded as a quarrel
within a family, best kept with-
in the family.
There was, however, a more
positive element which, made the
institution of Jewish arbitration
a :universal aspect of Jewish
community life. The Jew sought
cOmpleteneis in his own, com-
munity. Without desiring to
segregate himself from his neigh-
bors, the Jew sought to have_ his
JeWish community fill all the
needs of his Jewish life. To
resolve the differences that arose
among its members was there-
fore a responsibility of the or-
ganized Jewish communtiy.-
In 1930 the Jewish Concilation
Court of America was establish-*
ed in New York. It stated its
objectives to be "to advance the ,
cause of the amicable adjustment
of disputes, differences and mis-
understandings arising between
persons affecting the good name
and reputation of Jewry; be-
tween Jewish persons and Jewish
organizations involving disputes,
differences, and misunderstand-
ings of a specific character af-
fecting the Jewish people."
The Jewish COmmunity Coun-
cil through its Arbitration Com-
mittee seeks to preserve, within
our community, the best aspects
of this tradition. The members
of the Committee, trained and
expert in sifting evidence and
analyzing situations and gifted
with profound human sympa-
thies, give generously of their
time and skill and thus render
an important service. It is a sign
of communal maturity that such
an instrument is in our posses-
sion. It ought to be used when-
ever the situation warrants it.

Poland" Grants 3-Month
Immigration Extension
. WARSAW, (PTA)—As a re-
sult of discussions initiated by
Jewish communal leaders, Polish
authorities granted a three-month
extension of certain provisions fa-
cilitating the emigration of Jews
from Poland. The special provi-
sion for Jews were originally or-
dered suspended as of March 31,
1948.

in the trusteeship proposal.
Dr. Stephen S. Wise, speaking
at the founders' day dinner of
the Jewish Institute of Religion,
declared: - "Palestine as a Jewish
State of Judaea will live, but the
United Nations is doomed to die
unless the moral sense of man-
kind overrides the Bevins and
the Trumans and resolves that
the UN shall live." -
Prominent leaclers and news-
papers continue to condemn the
reversal in policy by. the U. S.
The N. Y. Post, in an editorial,
"Betrayal Reaffirmed," charges
President '‘Trurnan with xespons R
ibility for it, demands a Congres-'
sional investigation and urges
that the Palestine Commission
"should organize a provisional
government for. Palestine, grant
that government recognition as a
de facto government, and de-
mand in its, behalf the right of
all nations under the charter to
bear arms in its own defense."
In another editorial, the N. .Y.
Post asserts: "There have been
rumors that James Forrestal, Sec-
retary of Defense, has really tak-
en over -the Presidency of the
United States from Harry S. Tru-
man. It isn't so. It's just a half
truth. In Foreign Affairs, the new
President is really Ernest Bevin,
Foreign Minister of Great Bri-

Meanwhile frightful n e w s
comes from Palestine. It is be-
lieved that nearly 200 died in
this week's repercussions. Many
of the dead are Arabs who were
attacked in their military head-
quarters in Haifa. Several ex-
plosions . took place in Hamra
Square in the old Arab city and
many houses, believed to have
housed Arab military leaders and
ammunition, were destroyed.
It is expected that Senator
Owen Brewster of Maine will in-
troduce a measure in the U. S.
Senate expressing dissatisfaction
with the latest U. S. move and to
demand reaffirmation of our Gov-
ernment's traditional policy in
support of a Jewish State. Many
members of both Housed of Con-
gress are expected to back such
proposals.
Arthur Lourie, director -of the
Jewish Agency's New York of-
fice, in a statement addressed to
Karel Lisicky, chairman of the
Palestine Committee, • charged
that British military supplies
have been moved from Egypt to
Palestine this month for use by
the Arab Legion. He declared
that "the actions of the British
authorities in this regard are in-
comprehensible- in the light of
their professed neutrality in the
present situation in Palestine."

Detroit's Histadrut (Gewerk-
shaften) campaign scored the
greatest triumph in its 17-year
history fund-raising when it clos-
ed the 1948 drive with a total of
$245,000. This sum, announced at
the rally at Cass High on Sunday
evening, attended by nearly 3,000
people, is more than $100,000 in
excess of the amount raised last
year. /
A resolution unanimously
adopted by the audience con-
demned the latest betrayal of the
UN decision and demanded that
our government should live up to
its obligations in the entire issue.
Morris Schaver read the resolu-
tion after the children of the Far-
band Schools presented their gift
of $200 to the Histadrut.
Morris Lieberman presided at
the meeting. Sam Rabinowitz, di-
rector of the drive; reported on
the campaign's results. A musical
program was given by Cantor Leib
Glantz.
Charles Rubiner appealed to the
gathering to assist in making a
success of the Allied Jewish Cam-
paign and thus to reassert Jew-

In a ,stirring address, Bartley
C. Crum, who was one of the
American members of the Anglo-
American Committee of Inquiry
on Palestine, condemned the latest
betrayal of the UN decision and
asserted • that "America wants
peace not war, and even war won't
keep this administration in office."
He declared that he is worried
about "a great nation like ours
backing clown in the face of
threats from five or six Arab lead-
ers." He charged that Warren
Austin's statement to the UN was
"sheer sophistry and hypocrisy."
Condemning the arms embargo
which was imposed after the UN
decision, he declared that it was
"an embargo against the only na-
tion supporting the UN."
"I would like to see the states-
men speak out against the rape of
Palestine," .he declared. "What
they ate after is not a trusteeship
but an Arab state. But there'll be
no Arab state. There will be in
Palestine a Jewish state whether
the arms embargo is lifted or not.
Jews can take adversity and sur-
vive. The result of the latest act
wil be an intensification. of the
Haganah.°'

I Saw Them Stab Partition
LAKE SUCCESS.—I saw them stab partition. I heard Dean Rusk,
glib State Department spokesman, deceptively gentle, with laughing
crinkly eyes and a small, feminine mouth, announce America's re-
versal and seek'to justify. it at a press 'conference preceding Austin's
stab-in-the-back sta&ment to. the Security Council. It took long be-
fore the realization of what he was saying penetrated the incredulous
pressmen. When it did, their faces flushed with amazement, anger,
embarrassnient. When Dean Rusk revealed that. Senator Austin had
pledged , full American support for the enforcement of trusteeship,
the presSmen laughed in his face. We have heard that once before."
"Is it 0:K. to send American' troops against partition, but wrong to
send them to defend partition?" Glib Dean Rusk sought to explain.
He was unctuous, but retreated before the white anger of the press.
The chronology of that Black Friday is revealing. At the morn-
ing session of the Security Council, Senator Austin read - a report on
Big Four negotiations, with Gromyko registering a dissent on some
points: Austin then proposed adjournment so that these minor ,dif-
ferences could be adjusted. The Security_ Council adjourned at 1
p.m., and the Big Four met again at 2 p.m., when Austin produced
from his pocket a large closely typed statement outlining the Ameri-
can reversal. The mere physical labor of typing it would take more
than one hour, and this kind of statement, it is assumed, is carefully
written and edited and submitted for approval to the Secretary of
State and President (we put` President last because he has long ago
abdicated to Loy Henderson and Forrestal). It would be at least a
day in writing. So that Austin had the double-cross statement in, his
pocket all that morning, warming his hands on it even when he called
for an adjournnient to straighten out minor differences among the
Big Four.
Reporters will recall also another incident that took place that
very week. A meeting of the Big Four was. arranged for Tuesday
afternoon, after a morning session at which the Big Four were safd
to have reached agreement. Mr. Gromyko apologized that he had
misunderstood and wouldn't be able to attend the afternoon meeting.
Courtesy required the other Big Three to cancel it until Mr. Gromyko
could join them. But they did not—they went ahead and it was at that
meeting that the conspiracy to stab partition was hatched. And to
confuse the issue, persons close to the U. S. delegation sneeringly
and knowingly referred to Grornyko's "diplomatic absence." They
impugned his motives at the very time they were tbbogganing parti-
tion over the precipice of international intrigue.
