U. S. Court Denies Dorothy Bistrow Wed to Texan;
Restitution Action Announce Sister Ruth's Betrothal

NEW YORK, -(JPS)—A pre-
cedent which may possibly ham-
per the restitution to Jews of
property confiscated by the Nazis
was set here when the U.'S. Cir-
cuit Court of Appeals, by a ma-
jority opinion, dismissed an ap-
peal brought by • Arnold Bet'n-
stein, one-time German Jewish
shipping magnate, who sought
$900,000 from a' Belgian shipping
company for the loss of one of
his ships which the Belgians had
bought from the Nazis just before
the war.
Stating the majority opinion,
Judge Learned Hand declared
that "this court will not under-
take to pass on the municipal
laws of another state or the acts
of officials of another state."
In dissenting opinion, Judge
Charles E. Clark held that the
arguments of the American pros-
ecutors at the Nuremberg War
Crimes trials should be taken as
a guide by the courts here as an
expression of government policies
toward acts committed under the
Hitler regime.
The court's ruling upheld the
Action of Federal Judge Alfred
C. Coxe, who dismissed a writ
of attachment Bernstein had ob-
tained against the assets of Van
Heyghen Freres Societe Anony-
me, of Antwerp, which had ac-
quired from the Nazis the S.S.
Koenigstein, one of three pass-
enger-cargo shops Bernstein op-
erated in the North Atlantic be-
fore 1937. Bernstein says that
his company, known as the Ar-
nold Bernstein Line, was confis-
cated unlawfully by the Germans
as part of their anti-Semitic pro-
gram.

Samuel Alman Dies

LONDON (JTA)—Samuel Al-
man, one of Britain's most prom-
inent Jewish composers, died at
the age of 70. Although his opera,
"Melech Ehad," produced in 1912,
met with great success, he de-
voted most of his energies to the
creation of liturgical works. His
musical settings to the poems of
Bialik and other Hebrew poets
are also among his better-known
compositions.
