'Attorney Asks Court Reporter Be Replaced Because He Is

a Jew; Bnai Brith Anti-Defamation League Held
Responsible for the Trials in Washington

WASHINGTON (JPS)—A strictly "Aryan" jury and the
elimination of all possible "Jewish Mongolian" influence
from the sedition trials in the U. S. District Court are sought
by attorneys for the defense as is indicated by questions
submitted by them to prospective jurors. To facilitate the
picking of the jury, Chief Justice Edward C. Eicher himself

questions jurors on the basis of
list of queries drawn up by at-
torneys for both sides.
The questions include the fol-
lowing: "What does Jew mean?
Does it mean religion, race or
people? Do you think Jews are
an international people? What is
Zionism? What does interna-
tional bankers mean? What is
meant by Mongolian Jew?" As
regards the last query, the Judge
remarked: "I don't know what
that means myself."
Bnai Brith Blamed
Ira Chase Koehne, a defense
attorney, came up with a motion
that the court reporter of the
trial be replaced because a Jew
is a member of the . firm now
handling the work. Koehne had
charged earlier that the Bnai
Brith Anti-Defamation League
was responsible for the trials,
that it was linked with the FBI
and maintained more elaborate
investigating machinery than
even the government agency.
In calling for the dismissal of
the court reporter, Koehne said:
"That the firm of Ward and
Paul are the present court re-
porters in this case and that one
member of said firm to wit Paul,
is a Jew, and that they do not do
satisfactory work . . that with
said racial, national and religious
fanaticism of at least the Jewish
member of said firm, the report-

in.. - of the case by said firm is
liable 'to be . . . biased and prej-
udiced."
Motion Dismissed
Justice Eicher swiftly dis-
missed the motion. At the report-
ing firm's office later Jesse L.
Ward, senior member, pointed
out that no officials of the enter-
prise were Jewish.
Edward James Smythe', Klans-
man, who failed to appear at the
opening of the trial was found
by FBI agents at Ausable, N. Y.,
40 miles south of the Canadian
border. He denied. having sought
to flee to Canada and said he 'had
thought the trial 'would open a
week later.
Arthur Sears Henning, Chicago
Tribune reporter, only news-
paperman with whom the • de-
fendants fraternize, was called to
the witness stand by Smythe's
attorney, James. A: Laughlin, in
connection . with the defendant's
claim that he had absented him-
self from the opening because he
did not know wlien the trial
would begin: , Justice Eicher sus-
tained the Government's objec-
tion that the testimony of the
witness was irrevelant.

Quotation on Sanctuary
Irks Nazis in Holland

WASHINGTON (JPS)—An Am-
sterdam stationer who displayed
in his window a plaque with a
Biblical quotation has been at-
tacked by Storm, organ of the
Nazi elite guard in Holland,
which charges that the stationer
intended the quotation as propa-
ganda for sanctuary to the Jews.
The quotation, from Isaiah 16-3,
reads: "Hide the outcasts. Be-
tray not him that wanders."' This
