sued for libel by Congressman
Martin L. Sweeney for distribut-
ing a release of "Washington
Merry-Go-Round" in which
Drew Pearson and Robert S. Al-
len had suggested that Sweeney
had tried to prevent a Cleve-
lander from becoming a federal
judge because he was a Jew.
The ruling was on an appeal
from a decision by Judge Ed-
ward A. Conger and a jury in
New York Federal Court in Feb-
ruary, 1941. Sweeney contended
in his appeal that the judge was
in error in not having advised
the jury that the article was li-
belous per se.
Congressman Sweeney, now
running for re-election, brought
a total of 70 suits for libel against
