from an Arab village near Beer-
sheba, carried her off in a mili-
tary jeep to a desert spot, raped
her and, after killing her with
a machine gun, buried the body
in the sand. The following day
a military patrol discovered the
body.
Tracing the wheel marks of the
jeep, the patrol was led to the
barracks of the accused, where
it was ascertained that Falik had
used the jeep the day before.
Police also found the gun and
other evidence.
At the trial, the military gov-
ernor of Beersheba testified that
he himself had made the investi-
gation and stated the facts as he
knew them.
The defendant, through his at-
torney, interjected a plea of not
guilty, declaring he was inno-
cent. The prosecutor, however,
contended that the accused com-
mitted the crime in cold blood
and he demanded imposition of

TEL AVIV- (WNS) -A 20-
year-old Israeli soldier who es-
caped death at the hands of Hit-
ler is fighting for his life here
before a court on charges of
having raped and killed a 12-
year-old Arabian girl.
The young defendant, David
Falik, first came to Israel two
years ago after escaping from
Russia, where he fought during
the war in the partisan army in
the Ukraine. He grew tip without
parents, living most of his life
in forests where he fought the
Nazis alongside Russian under-
ground forces. His entire family
was slain. The only survivor was
his mother, who reached Israel
from Poland soon after her son's
arrival. When Falik came to Is-
rael he immediately joined the
army.
According to the prosecution,
Falik kidnapped the young girl
