wife and instead sprayed an in-
nocent passerby with bullets.
The case against him was bad.
Five witnesses testified to his
misdeed.
O'Reilly had a weak alibi: He
had been working in a fish store
that day.
The prosecutor had a basket of
fish brought into court. He held
up a flounder. What's that?" he
asked. "A halibut," said O'Reil-
ly. There were 20 fish in the bas-
ket and O'Reilly was wrong 20
times. The accused grew gloomy.
The prosecutor rubbed his hands
in glee.

Then Leibowitz swung into ac-
tion. "All this is a fraud," he
charged. "In all that fish, was
there a pike, a pickerel, or any-
thing else that could be made
into gefulte fish? There was
not.
"My client said that he worked
in a fish shop in the heart of
the Jewish neighborhood. The
prosecutor very carefully avoided
showing a single fish that would
be sold there. This is a travesty

country.
"Gentlemen," he once told a
jury, "My client talks like an
idiot and acts like an idiot. Do
not be deceived. He really is an
idiot."

ON ONE vt..LASION Leibowitz
was the second of two scheduled
speakers at a banquet. The first
speaker held the floor so long
that everybody was ready to go
home by the time Leibowitz got
the floor.

"I'll only take a few minutes,"
he said. "I want to tell you a
story about a friend of mine who,
when he was a boy, saw his fath-
er throwing whole carrots
to his
hogs by the barrelful.
"A neighbor criticized this pro-
cedure. 'Don't give 'em whole
carrots,' he said. 'If you'd cut
them up and cook them the hogs
would eat then in half the time.'
My friend's father answered
simply, 'What's time to a hog?'"

SOMETIMES IN delivering a
sentence Judge Leibowitz tends
to speak at length. He was ex-
plaining a prison sentence to
one offender at length when the
latter cut in glumly, "Say,
Judge, is this a sentence or a
filibuster?"

LEIBOWITZ' FAVORITE joke,
is naturally enough, about law-
yers. It concerns the attorney
who journeyed to Los Angeles to
try an important case. He prom-
ised to wire his partner the mo-
ment a decision was reached.
Two weeks later the wire came
and it read, "Justice has tri-
umphed."
The partner in New York im-
mediately wired back, "Appeal at
once."

story about Leibowitz which il-
lustrates both his legal ability
and his acute wit. A fellow
