He was in- dicted ; publicly tried by a jury of his peers ; was represented by counsel ; and the jury empanelled in the cause ; was instructed by the Court that he is pre- sumed to be innocent; and that the Gov- ernment must overcome that presumption by evidence that convinces beyond doubt ; was convicted by the unanimous vote of the jury and sentenced by the Court. Some of our impatient and impulsive friends would have us suspend the above described procedure in the cases of well known, vicious anti-Semites and in their impatience criticized Attorney General Francis Biddle for not proceeding against them with greater speed. We are not among those who would suspend due process. Only the most im- minent danger or the greatest emer- gency should remove these cases from the civil courts and place them in the hands of any other authority. We pride ourselves upon the fact that our courts are always open. Even in most parlous times the writ of habeas corpus was not denied. Certainly no one can say that these are parlous times ; or that the danger is imminent ; or the emer- gency great within the borders of our own land.
