Disagree on Bishop The jury failed to agree in the cases of: William Gerald Bishop, described by the Government as the ringleader of the alleged plot; Macklin Boettinger and John Albert Viebrock. Captain John T. Prout, Jr., of the 165th Infantry, New York National Guard, was acquitted of con- spiracy to overthrow the Govern- ment, but the jury disagreed about his guilt of conspiring to steal munitions. William H. D. Bushnell, Jr., was acquitted of one charge but the jury disagreed on another count. When the trial began on April 3, there were 17 defendants, but one of them, Claus Gunther E•- necke, committed suicide on April 11, and two others, George M. Kelly and Edward L. Walsh, were discharged by Judge Mar- cus B. Campbell. The Government, through the testimony of more than 40 agents of the Federal Bureau of Investigation, sought to prove that the Christian Frontists planned to incite "Jews and Com- munists" to riot, then seize the Government after a counter- revolution. 13 and the Legal Chronicle MRS.
