A decree granting a permanent injunction against the enforce- ment of the Michigan alien regis- tration bill was signed Monday morning by Judge Charles C. Simons of the United States Cir- cuit Court of Appeals and the Federal District Judges Ernest A. O'Brien and Edward J. Moinet. Sitting in special session, the three judges granted the request for this decree made by Theodore Levin and Attorney General-elect Patrick II. O'Brien, who headed the corps of counsel who fought against the bill after it was passed by the Michigan Legislature, and signed by Governor Wilber M. Brucker, in 1931. Levin and O'Brien had as assisting counsel Fred M. Butzel of Detroit and Max J. Kohler of New York. Plea by O'Brien. The request presented to the three federal judges by Levin and O'Brien was for speedy action in dispensing with the measure, on the ground that in the event the case should come up again during O'Brien's administration as attor- ney general, he would be placed in the anamalous position of defend- ing a measure he opposed before he assumed public office. The alien registration act would have required all persons not born in the United States to be registered, photographed, fin- gerprinted, etc., under a heavy penalty. It was also made a crime for employers to have in their employ unregistered aliens. The bill was rushed through the Legis- lature with the utmost secrecy, and the general public was not aware of what had transpired un- til the act was ready for the Gov- ernor's signature, when a strong protest was made to him. Rubiner's Minority Brief. Judge Charles Rubiner of De- troit, then an assistant attorney- general, was among those who took up the cudgel against the proposed law. He prepared a 22-page opinion, in which he advised the Governor that the act was uncon- stitutlonol in many respects. Judge Rubiner's opinion was disregarded, however, and the bill was signed by the Governor. Judge Rubiner, who was the only official in Lan- sing who actively opposed the bill, was later appointed a Judge of the Common Pleas Court of De- troit.
