Permanent Restraining Order Is Asked Against Registration Measure A decree providing for a per- manent injunction against the enforcement of the alien regis- tration bill, which was declared unconstitutional by a three- judge Federal Court, was re- quested by Theodore Levin and Patrick Ii. O'Brien, Michigan's Attorney General-elect, who appeared for this purpose be- fore Judge Ernest A. O'Brien. The presentation to the court was made at this time for an immediate final disposi- tion of the case because the attorney general-elect was one of the attorneys for the plain- tiffs and the coming on of this case during his term of office might create an anomalous sit- uation of an attorney general being one of the defendants in a case where he has prviously been one of the attorneys for the plaintiffs. • Judge O'Brien set Dec. 19 as the date for the hearing on this request, which must be heard by three judges, includ- ing a member of the Sixth Cir- cuit Court of Appeals. Fred M. Butzel- and Max Kohler of New York were as- sociate counsel with Theodore Levin and Patrick II. O'Brien in the legal battle against the alien registration bill. ANNUAL A. Z. A. DAY ON SUNDAY, DEC. 18 The District Governor of Lwow and the police department of that city are accused of direct respon- sibility for the anti-Semitic ex- cesses there, because they failed to take adequate precautions to prevent the disturbances whore' Im- minence was evident a fortnight before they occurred, in an inter- pellation submitted by the Club of Jewish Deputies to the Polish Seim. , At the outset of the disturb- ances, the police of Lwow were not only passive but actually sided with the attackers, the Interpella- lion charges, and cites instances to support its contention that from first to last, the police sym- pathized with the rioters. Jews who defended themselves were ar- rested while the police refused to come to their rescue, and actually took part in the baiting of the Jews, the interpellation asserts. The interpellation shows that in the five day period from Nov. 26 to Dec. 2, 361 Jews registered for first aid treatment. The majority of them suffered from serious bead injuries as the result of being beaten up with iron bars or stabbed with knives. I The interpellation contains an ' exact list of all the injured with fuil names and addresses. The Club of Jewish Deputies will demand that the victims be paid damages. A fortnight before the mass at- tacks began, individual incidents directed against the Jews occurred in Lwow, such as the breaking of windows and attacks on Jewish stores. Jews were attacked on Szeinachs street, especially in the evening hours. The press drew the attention of the authorities to the growing disquiet in the district and the particular danger to which the Jews, worshipping in the district synagogue, were exposed, says the Nolo memoran- dum.
