the Federal Court, when three
judges heard the discussions on
the issue.
Judge Arthur C. Denison of the
Court of Appeals of the District
Court of Cincinnati presided and
conducted the hearings. Federal
Judges Ernest A. O'Brien and
Charles C. Simons were the other
two judges.
The outstanding feature at the
hearing was the profound respect
that was shown by the judges for
the opinions of Theodore Levin, as
embodied in the excellent 112-page
brief prepared by him and his as-
sociates, former Judge l'atrick H.
O'Brien, Fred M. Butzel and Nath-

LONDON,—(J. T. A.)—Facts
and figures to show that the eco-
nomic equilibrium of Palestine has
been restored are cited by the
Palestine government in its annual
report to the Mandates Commission
of the Legaue of Nations. The re-
port cites increased building activ-
ity, new buildings to the value of
$9,250,000, having been erected
during the year, and continued ex-
pansion of citriculture, and the slow
consolidation of the position of the
principal factories. The fact that
the Nesher Cement Works has
showen a profit of $90,000 and that
the Tel Aviv silicate plant has re-
sumed production is also pointed
out.
The lengthy report, which is
twice the size of previous reports,
contains a full reply to the ques-
tionnaire given the Palestine gov-
ernment last year by the Mandates
Denison thereupon declared that
the question of the opposition has
nothing to do with the legality of
the act. Mr. Butzel thereupon re-1
marked that he (lid not like to be'
classed with the Communists. !

was understood when he said that
the Communists opposed the bill.
He waxed humorous in declaring
that the Jews all opposed the bill
and that "all the Jewish organiza-
tions are- Communistic." Attorney
General Voorhies then took hold of
his arm and called him away with
the remark, "let's go, side-kick."
The most interesting portion of
the hearing undoubtedly was the
sharp and pointed interrogation of
Mr. Clardy's arguments by Judge
Simons. These interrogations re-
vealed the keen mind of Judge Si-
mons, whose questions pointed to
conflicts in the bill with the Fed-
eral Constitution, and forced Mr.
Clardy to admit that there may be
some portions in the bill which may
be faulty.
What aroused indignation and
resentment in the course of prepar-
ations for the hearing was the pre-
sentation of a brief to the court
by Louis M. Hopping, assistant
United States attorney, who as-
sumed to tell the court that al-
though the foreign born were only
22 per cent of this federal court
district's population, they commit-
ted 46 per cent of the crimes. In
the course of his address to the
court, Mr. Levin attacked these
figures as irrelevant to the issue
and said that if any crimes are
committed it is the government's
business to prosecute the offenders,
but that such figures have nothing
to do with the legality of the meas-
ure.
While it is understood that
Judges Denison, O'Brien and Si-
mons have already reached a decis-
ion on the bill, and that they are
now framing an opinion, it is be-
lieved in legal quarters here that
the decision may not be announced
fur another week.
Mr. Clardy, who was the sole de-
fender of the measure for the state
attorney general's office, in the
meantime carried out his threat to
insist on the 15-day-period to which
he is legally entitled for an answer
on the last two bills of complaint
in behalf of Francesco Dimeglio
and John Petrowski. Mr. Clardy
served notice on Theodore Lev-

The World Zionist Congress, in session at Basle, Switzerland, remained deadlocked at
noon on Thursday on the question of leadership. As the forms of this issue of The De-
troit Jewish Chronicle are being closed, the Labor groups at the Congress remain ada-
mant in their support of Dr. Chaim Weizmann, resigned leader, and are just as strongly
opposed to a coalition which would put an end to Dr. Weizmann's regime and policies.
Among the latest happenings at the Congress was the written apology of Dr. M. D.
Eder, president of the British Zionist Federation, to Dr. Stephen S. Wise, for calling him a
liar during the latter's address in which he atacked the British government. Meer Gross-
man, English Revisionist leader, whom the Zionist Executive had charged with having given to the gen-
eral press the contents of the Whate al'alpet/Of October, 1930, before that document was officially released
