the historical role of Judaism to

Jewish literateurs and intellectu-
als formally renounced Jewish in-
terests for the higher interests
of oppressed humanity." Only
one group—the Orthodox party
with Samson Raphael Hirsh at its
head—stalwartly fought for Jew-
ish traditions and rabbinic author-
ity, even renouncing emancipation
for the sake of tradition.
The more the Jews surrendered
their consciousness, short of apos-
tasy, and even that very often was
futile, the more cruel was their
position. Socially they were os-
tracized. Professionally they were
discriminated against. Personally
they were unacceptable. Theo gov-
ernments used every artifice to
make them uncomfortable. What
hurts a sensitive cultured Jew
more than this?
Judaism was in a complete pro-
cess of dissolution. To stave off
this doom, two movements became
active in Jewish life. The science
of Judaism and reform Judaism.
The first proposed to supply the
Jew who yearned for original re-
search a free, unrestricted field of
endeavor in the several aspects of
Jewish literature, as well as to re-
new and rebuild the culture of the
Jewish people. The second pur-
posed to revamp Judaism along the
outlines of the Paris Synhedrion,
for the avowed purpose of rally-
ing the hesitant and the recalcit-
rant around thy banner of Juda-
ism, albeit a Judaism sans peo-
ple, sans Zion, sans Messiah, sans
traditions and sans language.
The Historical School.
At first these two activities sup-
plemented each other. The Jewish
scholar became the Reform rabbi.
But due to the radical theories
held by the Reform proponents, a
second type of Jewish scholarship
appeared—the historical school.
This school of thought explained
Judaism as a civilization which de-
veloped historically through the
ages. Therefore they could not
accept concepts of Judaism which
regard it as an ordinary religion
whose golden era was the prophetic
age. While since then, for 2,500
years, Judaism did not develop in
proper authoritative forms. His-
torical scholarship argued for a
modern attitude towards rabbinieo
lore—but not under any circum-
stances its repudiation.
Reform in Germany, despite
everything, was not successful. Old
German communities were loath
to revolutionize their religious life.
Only the newly formed congrega-
tions were "Reform" so-called.
But their "Reform," as is well
known, is modern, but modern and
not at all commensurate with
American Reform.
Under these circumstances
many of the important Reform
leaders, particularly of the clergy,
became discouraged and decided
to go to America. Many of them
had difficulties with the govern-
mental authorities, others tired of
the constant hackling with their
opponents. For all these reasons,
they migrated to America.
We have described the Euro-
pean environment both Jewish and
non-Jewish of the second wave of
Jewish migration to America. We
have also pictured the American
environment into which these cen-
tral European Jews come. The
problems that confronted them we
shall discuss in the next article.

CARRIES CENTER CASE
TO COURT OF APPEALS

Judge Powell of the Court of Com-
mon Pleas in the Jewish ('enter

country as a test case between Or-
thodox and Conservative groups,
was filed in the Court of Appeals
in hehalf of the committee of Or-
thodox members of the Center, A.
A. Katz, chairman of the commit-
tee, announced.
The committee appealed against
Judge Po•ell's ruling that the
court has no jurisdiction over pure-
ly religious matters.
Walter J. Ilamilton, counsel for
the Orthodox committee, in his ap-
peal contends that the ruling of
Judge Powell is not correct in view
of the fact that by the constitution
of the congregation a trust was im-
posed upon the synagogue that it
be used for strictly Orthodox pur-
pos•s. This point of view was
clearly given expression in the pe-
tition of the plaintiffs and on this
question all authorities concur that
the court should and does have jur-
isdiction.
