Now that Louis D. BrandeilPhas taken his oath of office and all of
the mental hurly-burly attending his confirmation has subsided, we
can frankly discuss the entire affair.
The Brandeis case illustrates the need for a greater moderation
of opinion On the part of American Jews. No sooner was it discovered
that President Wilson's nomination of Mr. Brandeis was not going to
InA't with unanimous approbation, when some of the more near-
sight«1 of our co-religionists jumped at the conclusion that the reason
lay ir Brandeis' Jewishness. Their lead leas followed by publications
like the "Era," that arc only too ready to pose as champions of jus-
tice in any case which may be capitalized, anti all over the land arose
the cry that Brandeis was being made the victim of race prejudice and
anti-semitism.
Undoubtedly, there is some justification fur this attitude. l'n-
doubtedly, the fact that Brandeis is a Jew militated against him in
some quarters. But the great bulk of the opposition to his continua-
tion was not based upon racial or religious grounds. The great ma-
jority of Brandeis' opponents were sincere and honest in theirconyic-
tion that Louis D. Brandeis was not the right man for the office of
Supreme Court Justice. And while we may disagree with them, while
we may feel that their conclusion was unwarranted, we are bound to
respect their opinion, and we have no right to question their motives.
It is high time that some of our Jews realized the harm caused by
this constant talk of prejudice and anti-semitism. Some time ago
there was published in the "Warheit," a Yiddish daily of New York,
a statement that all of the justices of the Supreme Court opposed
Brandeis because he is a Jew, a statement both false and malicious.
What true American, whether Jew or Gentile, could read that article
without feeling a bitter resentment against those who openly slander
the men who have never before been slandered ; who accuse those
against whom no one ever dared breathe a word of accusation ; who
doubt the integrity of those whose sincerity and fairness no one dared
question—the Justices of the supreme tribunal of the Republic? That
feeling..of,reseutment gjew_it,tritle more intense and deep seated, when
a similar abusive charge was hurled against the person of Ex-Presi-
dent Howard Taft. And resentment against individual Jews,
fed and:nourished by incidents as those mentioned above, soon de-
velops into hatred of all Jews—the worst of all forms of anti-semitism.
Above all things, therefore, let the Jews of America not he so
prone to attribute opposition to a single Jew to opposithm to all
Jews. Let thent reserve judgment until they know the facts. Let
their attitude possess a little more of that spirit of tolerance, for the
lack of which among the other peoples of the earth they have suffered
